General Terms and Conditions Evim GmbH

scope 

The general terms and conditions (hereinafter referred to as "GTC") apply to all legal transactions that are carried out via the online shop www.evim.ch (hereinafter referred to as "OnlineStore"). Orders are accepted exclusively on the basis of the following conditions. Placing an order is deemed to be acceptance of these conditions. Deviations must generally be in writing. This cannot be waived verbally. Conditions of the client that deviate from these conditions are not valid.

Evim GmbH reserves the right to change these Terms and Conditions at any time. The version of these Terms and Conditions valid at the time of the order is decisive.

Deliveries are only made to addresses in Switzerland.

Orders in quantities not typical for households may be rejected without justification. Information will be provided exclusively by email. For all product orders requiring a minimum age of 18, the customer confirms compliance with these legal provisions by placing the order.

Offer and prices 

Prices that deviate from our price list must be agreed in writing. Verbal and telephone offers become binding through written order confirmation or order acceptance. The prices do not include packaging, freight, postage, insurance and other shipping costs. Samples, sketches, sample layouts, sample prints, etc. requested by the client are calculated individually. GZD are not charged additionally! 

The offers of Evim GmbH in price lists and advertisements are subject to change and non-binding.

All sales prices published in the online store represent final prices, including taxes and any advance VAT. Evim GmbH reserves the right to introduce a surcharge for small quantities. Evim GmbH is authorized to change prices of offers at any time. Paid services such as assembly, disposal, insurance, etc. are ordered individually. In the event of cancellation, Evim GmbH will charge 50% of the agreed conditions.

1.0 Availability and delivery 

Delivery is via Swiss Post. All information regarding availability and delivery times is without guarantee and can change at any time (even after the order).

2.0 Conclusion of contract / purchase contract 

The products and services in the online store are considered an offer. The offer is always subject to the conditions that terminate the contract if delivery is impossible or if the price is incorrect.

The purchase contract for products and services is concluded as soon as the customer makes an offer for the goods or services in the online store, by telephone, by e-mail or in person and Evim GmbH accepts this offer by shipping the goods or providing the service.

3.0 Delivery 

With the order confirmation, which is sent by email, the customer is informed of a provisional delivery date or the customer is contacted to agree on an individual delivery date. (e.g. vacation absence)

If Evim GmbH is late in delivering, the customer can exercise the right to withdraw from the contract from the 30th calendar day after the "order date". In this case, the customer must send an email to customer service. The money will be refunded within 14 days to the payment method or to an IBAN in Switzerland. Payment to a foreign account is not possible and will not be made. In this case, a credit will be made to the debtor account.

4.0 Delivery / Collection 

The customer can "pick up" certain products. The pick up takes place in St. Gallen. The customer can request this option by email. Evim GmbH reserves the right to change the delivery method. The customer will be informed of the change in writing by email. The product must be picked up within 14 days. If this does not happen, Evim GmbH reserves the right to cancel the order. If "procurement costs" have been incurred, these can be passed on to the customer. Invoicing will be done by invoice or on the refund in the event of cancellation.

5.0 Obligation to test 

The customer must immediately check the goods delivered or picked up for correctness, completeness and delivery damage. For deliveries of general cargo, a note must be made on the delivery note.

Damaged deliveries, incorrect and incomplete deliveries must be reported to Evim GmbH within 5 calendar days of the time of collection or delivery. The scan in the transport system/system of the carrier or collection system applies. This product must not be opened or put into operation. It must be kept in its original packaging. The return process is handled by customer service. Communication takes place exclusively by email in written form.

6.0 Guarantee and warranty 

Evim GmbH guarantees the absence of defects and functionality of the ordered product for 2 years after delivery or collection. Guarantee services can be provided as follows: 

- free repair 

- partial and complete replacement with an equivalent used/repaired product 

- Replacement with a new product from Evim GmbH 

- Credit at the current price (maximum sales price at the time of order)

Wear parts are excluded from the guarantee.

Special guarantee conditions apply to items listed with the note “stock exchange item”, etc. The customer will receive information about this via email from customer service.

7.0 Liability and disclaimer 

Liability is governed by the applicable statutory provisions. However, Evim GmbH shall under no circumstances be liable for (I) slight negligence, (II) indirect and consequential damages and lost profits, (III) unrealized savings, (IV) damages resulting from delayed delivery and (V) any acts or omissions of Evim GmbH's vicarious agents, whether contractual or non-contractual.

Furthermore, Evim GmbH is not liable for damages resulting from one of the following causes:

improper, non-contractual or illegal storage, adjustment or use of the products; use of incompatible spare parts or accessories (e.g. power supply);

failure to maintain and/or improper modification or repair of the products by the customer or a third party;

Force majeure, in particular natural disasters, moisture, falls and impact damage, etc., which are not

8.0 Payment 

All payment methods are available in the online store. Evim GmbH reserves the right to "block" certain payment methods and can adapt the offer on an ongoing basis. There is no guarantee for certain payment methods. The customer accepts the payment conditions with the order and is obliged to make all payments to Evim GmbH. Exception described under 8.1. Payment must be made in Swiss francs, or CHF for short. Cash payment is not possible for products and services. If payment is made in advance, delivery will only take place after receipt of payment. The products are reserved for 7 days, after which Evim GmbH can cancel an order and withdraw from the purchase contract. If the customer cancels, procurement fees may arise and these will be charged directly. (e.g. cancellation or import fees)

8.1 Purchase on account

Purchase on account with partial payment option (POWERPAY) MF Group / POWERPAY offers the payment method “Purchase on account” as an external payment service provider. With the individual invoice, you can easily pay for your online purchase by invoice. If you do not pay within the specified time frame, you will subsequently receive a monthly invoice with an order overview in the following month. When concluding the purchase contract, POWERPAY takes over the invoice claim and handles the corresponding payment terms. When purchasing on account, you accept in addition to our Terms and Conditions , the terms and conditions of POWERPAY. (powerpay.ch/de/agb).

9.0 Change of order or cancellation 

An order obliges the customer to accept the product. Subsequent changes or cancellations of orders can be accepted by Evim GmbH at its own discretion and a handling fee of 20% of the cancelled order value, but at least CHF 50.--, as well as any loss in value of the cancelled products since they were ordered, can be charged.

10.0 Return of goods as a consumer

Returns are generally possible. In any case, the customer must contact customer service by email at info@evim.ch. The return period is a maximum of 14 days from dispatch/collection. Every item that is returned is subject to a quality and individual inspection. If the customer is not satisfied with the result, the item can be returned for a handling fee. The costs for return, transport and re-storage are borne by the customer and will be charged to the customer at a rate of 20% of the value of the goods. The refund will be made within 2 weeks to the deposited payment method. 

We reserve the right not to accept returns for items with a value exceeding CHF 2,000.

All hygiene products and all personalized/individualized items are excluded from this right of return.

10.1 Return as a company 

In some cases, we offer goodwill returns for companies. These are subject to individual review.

11.0 Repair outside the warranty 

The costs for repairs outside the warranty period are borne by the customer.

12.0 Further provisions 

Returns that cannot be assigned to a customer are stored for three months and then disposed of.

13.0 Product descriptions

The product descriptions in the online shop are written by distributors and manufacturers and automatically sent to us.

We carefully check the product descriptions for accuracy, but cannot guarantee their accuracy.
